BICYCLE HIRE AGREEMENT – GRANADA & MÁLAGA
This Bicycle Hire Agreement (“Agreement”) is entered into by and between Cycle Sierra Nevada (“the Company”), operating in Granada and Málaga, Spain, and the hiree (“the Renter”). By making a booking online, the Renter has, by electronic acceptance, expressly agreed to all terms set forth herein.
1. Acceptance, Recitals and Incorporation
WHEREAS, the Renter has accepted the terms of this Agreement at the time of booking; and WHEREAS, the Company and the Renter desire to establish the legal parameters for the rental of the Company’s bicycle(s).
Accordingly, the Renter acknowledges that the rental is subject to and governed by the terms and conditions below.
2. Optional Bike Hire Insurance – Recommended Protection
2.1 Insurance Offer. The Company offers an optional Bike Hire Insurance (“Insurance”) available for purchase at the time of booking. It is strongly recommended that the Renter elect to obtain such Insurance to mitigate any potential risk.
2.2 Coverage. The Insurance, if purchased, shall provide coverage for the full value of the hired bicycle in the event of any crash or incidental accidental damage. This includes comprehensive roadside assistance, whereby the Company or an authorized agent will provide a crash replacement bicycle, and arrange for collection and return services should the bicycle become immobilized due to accident or breakdown.
2.3 Exclusions and Excess. Notwithstanding the foregoing, the Insurance does not cover theft or loss of the hired bicycle. An excess of €250 shall apply to any claim submitted under the Insurance.
2.4 Example of Risk Exposure. For instance, the bicycles provided by the Company are equipped with sophisticated components such as Shimano Di2 or SRAM eTap systems. A minor crash or inadvertent drop of the bicycle could result in damage to critical components (e.g., STI lever or derailleur) with repair or replacement costs in excess of €300, not including supplementary parts and labour. In light of such risks, the Insurance is designed to be the most economical and effective option for safeguarding your hire.
3. Use Restrictions, Road Safety and Conduct
3.1 Road Use Only. Hired road bicycles must not be used off-road or on unpaved surfaces. Gravel use, downhill, or trails are strictly prohibited.
3.2 Compliance with Spanish Road Laws. The Renter agrees to abide by all Spanish road rules, including:
- Helmets are mandatory outside urban areas and strongly recommended at all times.
- Use of lights during low visibility conditions is required.
- Use of mobile phones while riding is strictly prohibited.
- Riding under the influence of alcohol or drugs is illegal.
4. Rental Period, Delivery and Late Fees
4.1 Rental Period. The rental begins from the agreed start time confirmed during booking.
4.2 Late Returns. Late returns will incur charges of €20 per hour or part thereof unless previously arranged.
5. Condition and Inspection of the Bicycle
5.1 Delivery and Inspection. At the time of handover, the Renter shall promptly and thoroughly inspect the bicycle and its accessories. The Renter warrants that upon taking possession, the tires are in satisfactory condition and that the brakes and gears function properly. By signing the handover document, the Renter confirms acceptance of the bicycle’s condition, subject only to normal wear and tear.
5.2 Acceptance of Condition. Failure to inspect the bicycle immediately shall be deemed an acceptance of its condition. For example, if a dropped chain causes damage to the frame, the Renter acknowledges that a minimum repair charge of €250 shall be imposed for carbon or paint repairs.
5.3 Cleaning Responsibility. Bicycles must be returned in a reasonably clean state. Excessive cleaning will incur a surcharge of €30.
5.4 Tire & Brake Wear. Excessive wear on the rear tire or visible damage from heavy braking will be assessed and charged at replacement value.
6. Payment, Deposits and Cancellation Provisions
6.1 Payment Terms. Full rental payment shall be collected one day prior to the commencement of the hire period.
6.2 Security Deposit and Documentation. A refundable deposit of €200 per bike, along with valid photo ID and a credit card, must be presented at pickup.
6.3 Cancellation and No-Show. Should the Renter cancel the booking within seven (7) days of the scheduled hire period, or fail to present for pickup, the Renter shall be liable for the full hire price. At the Company’s sole discretion, the Renter may be offered a refund or reschedule option.
7. Mechanical Responsibility
7.1 Incident Reporting. The Renter is required to report any mechanical issues as soon as they occur.
7.2 Return Obligation. It is the Renter’s responsibility to return the bicycle to the Company’s premises in the event of a breakdown or malfunction.
8. Reserved Rights and Authorization for Payment
8.1 Credit Card Retention. The Renter hereby authorizes the Company to retain and use the credit card information provided at the time of booking as security against all liabilities arising under this Agreement.
8.2 Payment for Liabilities. In the event that the hired bicycle is stolen, or that any damage or crash occurs—including, but not limited to, incidents where the bicycle incurs damage that necessitates repair or replacement—the Company shall be entitled, at its sole discretion, to charge the retained credit card for any and all costs incurred, including repair, replacement, and associated legal expenses.
8.3 Additional Charges. The Company reserves the right to levy additional charges for excessive cleaning, damage beyond normal wear and tear, or any outstanding liabilities incurred by the Renter.
9. Limitation of Liability and Governing Law
9.1 Limitation of Liability. The Renter acknowledges that the rental of the bicycle is at the Renter’s exclusive risk. The Company shall not be liable for any personal injury, loss, or damage arising from the use or operation of the bicycle, except where such injury or damage is demonstrably caused by the Company’s gross negligence or intentional misconduct.
9.2 Governing Law. This Agreement shall be construed and governed in accordance with the laws of Spain. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Spanish courts, located in the province of Granada.
